Hibberts offers expert advice and assistance for any client in relation to the creation of pre-nuptial agreements.

Pre-nuptial agreements are a type of legal agreement drafted before the impending nuptials between parties. They can cover the division of assets, provisions for current and future children upon the unfortunate scenario whereby relationships breakdown. The UK Courts deem pre-nuptial agreements to potentially be decisive and persuasive but not automatically binding when relationships breakdown.

For pre-nuptial agreements to be persuasive, there is set criteria to be followed, for example the following: –

• The agreement must be made at least 28 days before the wedding
• Both parties must have received legal advice
• Both parties must understand the implications of the agreement

Our Specialist Team can assist you in every stage in the creation of a pre-nuptial agreement, including but not limited to the following: –

• Advising on the fairness and validity of an agreement
• Compiling full and frank disclosure for exchange with the other party
• Drafting pre-nuptial agreements based upon the agreement reached
• Negotiating a fair agreement on behalf of clients, ensuring all the relevant criteria are abided by
