It is essential that employees are provided with a contract of employment (or as a very minimum what is called a ‘Section 1 statement’ which sets out the terms & conditions of employment) as this document, along with any company policies will form the basis of the relationship between the parties. It will set out the rights of both parties but also their obligations.
Inevitably in the case of disputes the first document we need to turn to is the employee’s contract of employment. That demonstrates just how important those documents are but unfortunately they are not always given the attention that they deserve.
It is also possible for an employee to be awarded between 2 – 4 weeks pay by an Employment Tribunal for failure to provide a section 1 statement. This is something that can so easily be avoided, at relatively little cost.
