Years of history

Since the Renters’ Rights Act was introduced in May 2026, it has become more important than ever for landlords to follow the correct legal procedure when evicting tenants and regaining possession of their property.

Possession proceedings and eviction disputes can quickly become stressful, time-consuming, and messy for both landlord and tenant if they are not handled properly. At Hibberts Solicitors, our possession proceedings solicitors in Cheshire help landlords and tenants throughout Crewe, Nantwich, Northwich, Whitchurch, Tarporley, and the surrounding areas to resolve eviction disputes.

Whether you’re a landlord in Runcorn seeking to evict a tenant for anti-social behaviour or a tenant in Middlewich who wants to claim compensation for unlawful eviction, contact Hibberts Solicitors in Cheshire today for practical, straightforward legal advice.

What are possession proceedings?

Possession proceedings are the formal legal process that landlords must follow in order to evict a tenant and regain possession of their rental property.

Since the end of Section 21 notices, landlords may now only start possession proceedings by serving the tenant a Section 8 notice and providing valid legal grounds for doing so.

If a tenant does not leave the property after notice has been served, the landlord may need to apply to the court for a Possession Order.

What grounds can landlords use to start possession proceedings

Landlords can now only start possession proceedings using one of the grounds listed under Section 8.

At Hibberts Solicitors, we help landlords across Cheshire to lawfully regain possession of their rental properties as quickly and smoothly as possible by identifying the most appropriate Section 8 grounds for possession.

Some of the most common grounds for possession include:

  • Rent arrears
  • Anti-social behaviour
  • Breach of tenant agreement
  • Damage to the property
  • Persistent late payments
  • Landlord wants to sell the property
  • Landlord or family member wants to move into the property

Our solicitors can also help you to prepare and serve a Section 8 notice using the correct notice period and gather the evidence needed to support your claim.

Defending a possession claim (for tenants)

Reforms introduced by the Renters’ Rights Act have strengthened tenant rights to create a fairer and more secure private rented sector.

If you don’t think your landlord has lawful grounds to evict you or if they have not followed the correct legal process to do so, it’s important to speak to a solicitor as soon as possible.

At Hibberts Solicitors, our eviction disputes solicitors are here to help you understand your legal rights. We may be able to help you with defending a possession claim if:

  • Your landlord has breached their contractual obligations.
  • The Section 8 notice you’ve been served is invalid.
  • You have not been given the correct notice period.
  • Your landlord does not have evidence of their allegations.
  • Your landlord has not protected your deposit in a government-approved scheme.

Seeking legal advice from our team as soon as possible can help to strengthen your position.
